1. Acceptance of Terms

Welcome to PenipuMY, a community-driven platform dedicated to protecting Malaysians from online fraud. These Terms of Service govern your use of our website, services, and features. By creating an account or using our services, you acknowledge that you have read, understood, and agree to these Terms.

2. Eligibility

To use PenipuMY, you must:

• Be at least 13 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Comply with all applicable laws and regulations

3. User Accounts

Account Creation

You may create an account using:

• Email and password
• Google OAuth
• Telegram authentication

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4. User Conduct and Responsibilities

Permitted Use

You may use PenipuMY to:

• Search and verify potential scammers
• Submit legitimate scam reports with supporting evidence
• Contribute community input and collaborate with others
• Help protect the Malaysian community from fraud

Prohibited Conduct

You must NOT:

• Submit false, misleading, or defamatory reports
• Harass, threaten, or abuse other users
• Impersonate any person or entity
• Upload malicious code, viruses, or harmful content
• Attempt to bypass security measures or access restrictions
• Scrape, harvest, or collect data without permission
• Use the platform for any illegal purposes
• Spam or abuse the submission system

5. Content Submission and Reports

Accuracy Requirements

When submitting scam reports, you must:

• Provide truthful and accurate information
• Include genuine evidence (screenshots, documents)
• Avoid exaggeration or fabrication
• Report only genuine fraud experiences

Content Ownership

By submitting content to PenipuMY:

• You retain ownership of your original content
• You grant us a worldwide, non-exclusive license to use, display, and distribute your content
• You warrant that you have the right to share the submitted content
• You understand that reports may be publicly displayed to protect the community

Content Moderation

We reserve the right to:

• Review, verify, and moderate all submitted reports
• Remove or reject reports that violate these Terms
• Delete content that is illegal, harmful, or inappropriate
• Take action against users who violate these Terms

6. Intellectual Property

All content, features, and functionality of PenipuMY (including but not limited to text, graphics, logos, icons, software, and design) are owned by PenipuMY or its licensors and protected by copyright, trademark, and other intellectual property laws.

7. Third-Party Services

PenipuMY integrates with external services including:

• SemakMule (PDRM): Police report verification
• Caller ID Services: Multi-source phone number identification
• ToyyibPay: FPX payment processing for user tipping
• PayPal: Donation processing for platform development support
• Google Play Billing: In-app subscription processing for PRO features

Your use of these services is subject to their respective terms and policies.

8. API Usage & Commercial Use

Permitted Use

You may use PenipuMY's API under the free tier (100 requests/day) for:

• Academic, research, or educational purposes (e.g. Final Year Projects, coursework, learning)
• Development, testing, and prototyping before launch
• Any product or service that is free to its end users

Prohibited Use

You may not use PenipuMY's API under the free tier if:

• Your product or service charges its end users, in any form — including subscriptions, one-time fees, in-app purchases, or paywalled features — regardless of category (fintech, e-commerce, food delivery, scam-checking, or otherwise)
• You resell, sub-license, or redistribute PenipuMY's API responses as a standalone data product

Academic and testing use is exempt from these restrictions provided the API is not yet powering a publicly accessible, revenue-generating product. Once your product is paid or monetized, contact us for a commercial plan (Starter, Business, or Enterprise) before public launch. Violation of this section may result in API key suspension or termination.

9. Mobile Application

Community Shield

Community Shield is an opt-in feature where you share your phone contacts to help improve scam detection for the community. By enabling Community Shield, you grant the app permission to:

• Read your phone contacts (names and phone numbers only)
• Upload contact data to our server for scam cross-referencing

You may disable Community Shield at any time from the app.

Scam Protection

The app provides real-time scam protection features including:

• Call screening via Android Call Screening Service
• Notification monitoring to detect scam contacts
• Overlay alerts during incoming calls from suspected scam numbers

The app does not record calls, read SMS content, or transmit personal conversations.

PRO Subscription

The mobile app offers a PRO subscription with enhanced protection features:

• Subscriptions are billed through Google Play at the prices displayed at time of purchase
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
• You can manage or cancel subscriptions from your Google Play account settings
• Refunds are subject to Google Play's refund policy

10. Disclaimers and Limitations

No Warranty

PenipuMY is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not guarantee:

• The accuracy or completeness of scam reports
• Uninterrupted or error-free service
• Prevention of all fraud or scams
• Verification of all submitted information

Limitation of Liability

To the fullest extent permitted by law, PenipuMY and its operators shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of profits, data, or opportunities
• Damages resulting from use or inability to use our services
• Actions taken based on information found on our platform

11. Indemnification

You agree to indemnify and hold harmless PenipuMY, its operators, and affiliates from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your submission of false or defamatory content
• Your violation of any law or rights of third parties

12. User Data and Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

13. Donations & Tipping

Users may choose to support report submitters or the platform developer through voluntary contributions:

• User-to-user tipping is processed via ToyyibPay (FPX online banking)
• Donations to the platform developer are processed via PayPal
• Contributors may earn credits and level up based on community support
• All transactions are subject to the respective payment processor's terms and fees
• Donations are non-refundable unless required by law

14. Termination

We reserve the right to:

• Suspend or terminate your account for violations of these Terms
• Remove content that violates our policies
• Discontinue or modify our services at any time
• Refuse service to anyone for any lawful reason

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of PenipuMY after changes constitutes acceptance of the updated Terms.
